Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you ("you", "user") and Antony White trading as Color Mindful ("we", "us", "our") when you use the Color Mindful service at colormindful.com (the "Service").

By creating an account or making a purchase, you confirm that you accept these Terms. Our Privacy Policy describes how we collect, use, and protect your personal data and is incorporated into these Terms by reference.

Color Mindful is a web-based digital colouring book. We provide line-art images that you can colour in your browser, save your progress, and (with a paid subscription) sync between devices.

We may add, remove, or change features at any time. If a paid feature is materially reduced or removed, we will notify subscribers and offer a pro-rata refund where appropriate.

You must be at least 18 years old to use the Service. By creating an account you confirm you meet this age requirement.

We may suspend or terminate accounts that violate these Terms, are fraudulent, or have not been logged into for over two years (with reasonable notice). A cancelled subscription on its own does not count as inactivity if you continue to log in.

4. Payments and subscriptions

Pack purchases

A pack purchase grants you a perpetual, non-transferable, non-exclusive licence to access the images in that pack while your account remains active. Pack purchases are processed via Stripe; we do not store your full card details.

Subscriptions

A subscription grants you access to all current and future packs while it remains active, plus cloud sync between devices.

Pricing changes

We may change prices for new purchases or future subscription renewals. We will notify subscribers at least 30 days in advance of any price increase. Continued use after the notice period constitutes acceptance.

Failed payments

If a renewal payment fails, we will retry once and then suspend Service access until payment is resolved. Your colouring progress is preserved during suspension.

Chargebacks

If you have a problem with a purchase, contact us first at hello@colormindful.com — we will respond promptly and aim to resolve directly. If you initiate a card-issuer chargeback without contacting us first, we may suspend your account pending resolution and may charge an administrative fee of up to £15 for processing the dispute. 7. Your content

When you colour an image, the resulting coloured artwork is yours. You retain ownership and may share, print, or use it for personal non-commercial purposes.

If you choose to share a coloured image publicly, we encourage you to credit Color Mindful but it is not required.

By using the Service, you grant us a non-exclusive, royalty-free, worldwide licence to store and process your colouring data on our infrastructure for the purpose of providing the Service (including cloud sync between your devices). All such processing is governed by our Privacy Policy.

8. Our intellectual property

All line-art images, the visual design of the app, the brand, the logo, and all software comprising the Service are owned by us or our licensors and are protected by copyright, trade mark, and other intellectual property laws.

The line-art images are licensed to you for personal, non-commercial colouring use only. They may not be redistributed, resold, or used in commercial products.

9. Service availability

We aim to provide the Service 24/7 but we do not guarantee uninterrupted availability. We may need to take the Service offline for maintenance, updates, or due to circumstances beyond our control. We are not liable for losses caused by Service downtime.

The Service is provided "as is" and "as available" without warranties of any kind beyond those required by law.

Nothing in these Terms limits liability that cannot be lawfully excluded under UK law (such as for death, personal injury, or fraud).

You may close your account at any time from your account settings or by emailing us. Upon closure:

We may terminate or suspend your account if you breach these Terms, with notice except in cases of serious breach. We will issue a pro-rata refund of any unused subscription period if we terminate without cause.

13. Changes to these Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance.

If you do not accept the new Terms, you may close your account and request a pro-rata refund of any unused subscription period.

14. Governing law and disputes

These Terms are governed by the laws of England and Wales. Any disputes will be settled by the English courts.

If you are a consumer, you may also have rights to bring proceedings in the courts of your country of residence under EU law.

15. Severability

If any part of these Terms is found to be unenforceable, the rest remain in effect.
